Title 1, Part 1

The Texas Military Preparedness Commission (Commission), within the Office of the Governor, files this notice of intention to review 1 TAC Chapter 4, concerning the Texas Military Preparedness Commission, including Subchapter A, concerning the Texas Military Value Revolving Loan Fund Program, and Subchapter B, concerning the Defense Economic Adjustment Assistance Grant Program. The review is being conducted in accordance with Texas Government Code §2001.039.

An assessment will be made by the Commission as to whether the reasons for adopting the rules continue to exist. Each rule will be reviewed to determine whether to readopt, readopt with amendments, or repeal the rule.

Concurrently with this notice, the Commission is publishing proposed readoption with amendments of 1 TAC §§4.1 - 4.5, 4.7, 4.8, 4.30, 4.32 - 4.34, and 4.36 - 4.40, and the proposed repeal of 1 TAC §4.6, in the Proposed Rules section of this issue of the Texas Register. The proposed amendments and the proposed repeal are being proposed as a result of the Commission's review under Texas Government Code §2001.039.

Title 19, Part 2

Texas Education Agency (TEA) proposes the review of 19 TAC Chapter 76, Extracurricular Activities, Subchapter AA, Commissioner's Rules, pursuant to Texas Government Code, §2001.039.

As required by Texas Government Code, §2001.039, TEA will accept comments as to whether the reasons for adopting Chapter 76 continue to exist. The public comment period on the review begins October 9, 2026, and ends November 9, 2026. A form for submitting public comments on the proposed rule review is available on the TEA website at https://tea.texas.gov/laws-and-rules/commissioner-rules-tac/commissioner-education-rule-review.

Windham School District

Title 19, Part 8

Windham School District files this notice of intent to review the entirety of Chapter 300, regarding General Provisions, found in Title 19, Part 8, Texas Administrative Code. Chapter 300 includes two rules: §300.1, Public Presentations and Comments to the Windham School District Board of Trustees, and §300.2, Windham School District Board of Trustees Operating Procedures. This review is conducted pursuant to Texas Government Code § 2001.039.

An assessment will be made by the board as to whether the reasons for initially adopting the rule continue to exist. The rule will be reviewed to determine whether to readopt, readopt with amendments, or repeal the rule.

Adopted Rule Reviews

Department of State Health Services

Title 25, Part 1

The Texas Health and Human Services Commission (HHSC), in its own capacity and on behalf of the Texas Department of State Health Services (DSHS), adopts the review of the chapter below in Title 25, Part 1, of the Texas Administrative Code (TAC):

Chapter 231, Requests for Information or Official Determination on Food Regulation

Notice of the review of this chapter was published in the August 21, 2026, issue of the Texas Register (51 TexReg 5555) for public comment.

The 31-day comment period ended September 21, 2026. During this period, HHSC did not receive any comments regarding the proposed rule review.

HHSC has reviewed Chapter 231 in accordance with Texas Government Code §2001.039, which requires state agencies to assess, every four years, whether the initial reasons for adopting a rule continue to exist.

The agency determined that the original reasons for adopting all rules in the chapter continue to exist and readopts Chapter 231. Any amendments, if applicable, to Chapter 231 identified by HHSC in the rule review will be proposed in a future issue of the Texas Register.

This concludes HHSC's review of 25 TAC Chapter 231 as required by Texas Government Code §2001.039.
